Question by Cassandra: How long after an injury can i sue a home owners insurance?
I got injured two years ago september, driving a go-cart in my brothers back yard. I was going around a tree to turn and hit a whole in the yard and flipped. I ended up tearing two of my tendons in my left hand and having surgery six months later. I’m still having trouble till this day with my hand. Can I sue my brothers home owners insurance?

Of course you can sue. As long as you pay the filing fee, the courts will accept any lawsuit that you bring.

I don’t believe you are likely to prevail as your were operating a vehicle in an inappropriate place or way.

    You cannot “sue a homeowner’s insurance.” Such a suit would be immediately tossed out of court because the insurer had no part in your injury. You must sue the HOMEOWNER directly.

    You can ATTEMPT to negotiate a settlement with his insurance, but it will probably be denied due to the activity you were engaged in.

    His premiums will go up.
    You can’t just make a claim and expect the premiums not to go up.
    Plus, he may have a $ 10,000 deductible – you’d be surprised how many people have it this high

    Did you originally file a claim when the accident happened? Or 6 months later? Why do you want to file a claim now…two years later? Home owners insurance isn’t going to cover this anyway. It’s like shooting yourself in the foot. The property didn’t cause the accident, recklessly driving a go-cart caused the accident.

    Here in the USA, you can sue anyone you want. If you sue the insurance company, you’re going to lose.

    You’d have to sue your brother. And most likely, you’ll lose – because YOU were driving, and YOU caused the accident. Even if you win, if you live with your brother, his insurance won’t pay out, because you live with him.

    How long you can sue, depends on what state you live in. Each state limits it, called the “statute of limitations”. Most states, it’s 2 or 3 years, but some states let you go as long as 7.

    It depends upon what state you live in. In most it is one year from date of injury or when you discovered injury. I would suggest calling the local Bar Association for your state and asking them if they will tell you or refer you to an attorney. Most personal injury attorneys have free consultations.
