Question by AJR: Will my home owners insurance pay for damage done by my mentally disabled son to a neighbors car?
My autistic son (17) was out in our front yard and picked up a pair of hedge-clippers we had been using and threw it at a car damaging the rear door. He was having an autistic moment of rage and we could not get to him fast enough to stop what was happening. will our home owners insurance take care of it?

I think it will, but your deductible may be prohibitively high.

    Even if it would, your deductible would apply and I doubt it would be wise to submit such a small claim.

    The liability coverage portion of your homeowners policy is what is in play here. I’ve been in the property/casualty insurance business for a long time and I’ve yet to see the deductible on a homeowners policy apply to a liability claim. I don’t think you have to worry about the deductible.

    It would come out of the liability portion so no deductible would apply. Coverage depends on your policy wording and the cognitive state/age of your child. Your insurance company will have to review for coverage.

    the liability portion of your policy would be in effect here – there is no deductible.

    only way they wouldn’t pay is if they considered this an “intentional act” from what you describe that is not the case.

    maybe find out how much the damage is first? maybe you can cover it? otherwise you should have a covered claim
