Question by Aprilbride: Who do we file a complaint with on the company who finances our auto loan?
I was wondering if you could assist me in trying to find out who to contact and how to file a complaint on a business who finances our auto loan. We and our references are being harassed almost daily by our new loan officer. We had a loan officer that handled our account and when we started receiving calls we tried to call him leaving messages and never got replies. Then we finally after having hateful messages left on our phones as well as our references phones found out this new guy had taken our our account and we were trying to contact the wrong person. The new loan officer calls before the payment is ever due, is always telling us they need us to post date a checks, contacts our references telling them we haven’t made our payments and leaves hateful messages on our phones and theirs as well. Whenever we return his calls he is never there, they give us a hard time, they don’t let him know we called or put the information we give them in their computers. We have called and spoke with his supervisor who behaves the same way. Any help you can give us would be greatly appreciated!
In a phone conversation today the man even mentioned we always make our payments on the 15th or the last day of the month and asked is that when you get paid. We said yes. We are not behind in our payments as far as not making them we haven’t missed a payment at all. It was just last months payment was late a few days and now they say they changed their policies that it must be no later than 48 hours late or they will begin calling everyone. He was calling days before the payment was even due demanding we give him a post dated check for the one that was past due and also for the upcoming month that isn’t due until April 24th.
It is not a collection company but a loan officer.

Is this a loan officer or a collections agent? Sounds like you need to establish a history of paying your bills on time.

It is illegal for them to contact references and tell them that you are late on payments. They can contact them to see if they know where you are but can not give any info about the account status.

I would contact the state attorney general and see if they can help.

    Contact the Better Business Bureau and they will investigate it. http://www.bbb.org You should also look up that business and see if they already have cases pending or how they score. Good Luck!

    First off, if they are contacting your references and telling them anything about your personal business, they are violating the fair credit act and need to be reported.

    If they were to keep up this illegal collection proceedings you could sue them. They are counting on you not knowing your rights as a debtor.

    Do NOT give them a post dated check. With the way they break the law anyways, they would probably try to cash it early.

    I think the FTC oversees this sort of thing.

    Sounds almost like Drive financial lol. Ok this is simple ….First I don’t know what state you live in but I am sure your state provides protection for this sort of matter you need to contact the state of _____ consumer finance division ( it will probably be a similar name) All you have to do is go to the state they are located in website and look through the directory. File a complaint with them give them all of your Evidence and make sure it is in good order. If you were to go to the FTC nothing would happen, Just FYI they don’t have time for stuff like this, Don’t let them bully you! Also you could go to legal aid and get further advice because honestly I am pretty sure you could sue for damages. They caused you damage going to your references and you suffered from the harassment. Good luck!
